Revised rules to regulate sanction of financial
assistance for treatment of OBC patients under
the Nucleus Budget Scheme of the Department for
Welfare of Sch. Castes.

NOTIFICATION
In
supersession of all previous notifications/
orders Governor is pleased to frame revised
rules to regulate sanction of financial
assistance for treatment of OBC patients under
the Nucleus Budget Scheme of the Department for
Welfare of Sch. Castes.
1. Short
title, extent and commencement
These rules may
be called “ the Tripura O.B.C. patients
(financial assistance) Rules, 1996”. They extend
to the whole of Tripura and take immediate
effect.
2. Definition
i)
“Government” means the Government
of Tripura.
ii)
“Secretary” means Secretary to
the Government of Tripura/Commissioner to the
Government of Tripura, Department for Welfare of
Scheduled Castes.
iii)“Director”
means the Director for Welfare of Sch. Castes &
Other Backward Classes, Tripura.
iv)“District
Magistrate & Collector” means the District
Magistrate & Collector of a District of Tripura.
v)
“Superintendent of I.G.M./G.B./B.R.
Ambedkar/Cancer Hospital, Agartala” means the
Medical Superintendent of I.G.M./G.B./B.R.Ambedkar/Cancer
Hospital, Agartala.
vi)
“Director of Health Service”
means the Director of Health Services, Tripura.
vii)“District
Tribal Welfare Officer” means the District
Tribal Welfare Officer of a District.
viii)“Sub-Divisional
Officer” means the Sub-Divisional Officer of the
Sub-Division within which the patient normally
resides.
ix)“Medical
Officer” means the Medical Officer In-charge of
Government Hospital of Primary Health Centre
etc. in Tripura.
x)“Block
Development Officer” means the Block Development
Officer of a particular Rural Development Block
in Tripura.
xi)“O.B.C.”
means the communities recognized as such by the
Government by order issued from time to time.
xii)The
term “Poor” will means the member of a OBC
family living below the poverty line having an
Annual income of Rs. 11,000/- or less.
3. The Scheme
OBC
patients suffering from any desease/disability
may be granted financial assistance for their
treatment inside Tripura or Outside Tripura.
Provided that such financial assistance may be
sanctioned only to persons belonging to OBC who
are poor and are not in a position to meet the
expenses of treatment, subject to the
limitations and conditions laid down in Rule-4.Provided
further that no Government employee will be
eligible for getting assistance under the
scheme.
4. Authorities
competent to sanction assistance and
limitations of sanction.
i) Subject
to other conditions laid down in these rules the
Sub-Divisional officers (SDOs) Block Development
Officers (BDOs) shall be competant to sanction
financial assistance not exceeding Rs. 500/-
(Rupees five hundred) only per patient in a
financial year in case of urgent need for
treatment in any nearest hospital (excluding
District/State level hospital in Tripura. If the
S.D.O./B.D.O. consider the necessity of giving
further financial assistance exceeding Rs. 500/-
to any patient he may recommend the particular
case to the competent authority. While
recommending sanction of a higher amount, the
SDO/BDO must indicate the amount which has
already been sanctioned in favour of the
applicant.
ii) The
D.T.W.O. shall be competent to sanction
financial assistance not exceeding Rs. 500/-
(Rupees five hundred) only per patient in a
financial year for treatment in the District
level hospital. The D.T.W.O. West Tripura shall
be competent to cover state level hospital also.
If he considers that financial assistance
exceeding Rs. 500/- should be sanctioned to a
particular patient he will put up the case with
his recommendation to the D.M. and Collector.
iii) (a)
D.M. & Collector of a District shall be
competant to sanction financial assistance not
exceeding Rs. 1000/- only per patient in a
financial year for treatment in the nearest
hospital.
Provided that the D.M. & Collector, West Tripura
shall be competent to sanction financial
assistance not exceeding Rs. 2,500/- only per
patient in a financial year for treatment of
indoor patients of G.B. hospital, I.G.M.
hospital and Dr. B. R. Ambedkar hospital,
Agartala.
(b)If
he considers that financial assistance exceeding
his competency should be sanctioned to a
patient, he may forward the particular case with
his recommendation to the competent authority.
While recommending any particular case for
sanction of a higher amount of assistance, the
D.M. Collector shall indicate clearly the amount
already sanctioned in favour of the applicant.
iv) (a) The
Director for Welfare of SC and OBC shall be
competent to sanction to a OBC patient financial
assistance not exceeding Rs. 2,500/- only for
treatment inside the State.
(b) The
Director for Welfare of SC & OBC may recommended
any particular
case to the Govt. for sanction of financial
assistance upto Rs. 5,000/- only including the
assistance, if any, already sanctioned to any
patient for treatment outside the State.
iv) The
Secretary/Commissioner to the Govt. of Tripura,
Department for Welfare of S.Cs shall be
competent to sanction such amount of financial
assistance as he may consider proper and fit but
not exceeding the limit mentioned under
Sub-Rule-4(iv) (b).Provided
that the Government in Special circumstances may
sanction financial assistance exceeding Rs.
5,000/- for treatment outside the State but not
exceeding Rs. 8,000/- only.
VI) A
OBC patient can be sanctioned financial
assistance only once in a year, provided that
the Govt. may under special circumstance
sanction financial assistance to a patient twice
a year.
vii) Under
special circumstances Govt. may place fund with
the hospital authorities for sanction of payment
of assistance to OBC patients.
5. Procedure
for sanction and disbursement
i) The
sanctioning authority shall consider each case
for giving financial assistance on receipt of
application supported by a Medical certificate
from a Medical Officer, Superintendent of IGM/GB/B.R.
Ambedkar/Cancer hospital or Director of Health
Services.For treatment outside the State the
medical certificate shall be required to be
countersigned by the Director of Health
Services, Tripura.
ii)
Before according sanction the
sanctioning authority shall satisfy himself that
:-
a)The
applicant is a person belonging to OBC.
b)The
applicant is suffering from some desease/disability.
c)The
applicant is too poor to meet the expenses of
his treatment including other expenses of his
treatment including other expenses considered
essential for treatment.
iii)At the time
of disbursement of the amount sanctioned the
disbursing officer shall obtain proper receipt
from the person who has been sanctioned
financial assistance by the sanctioning
authority. The disbursing officer shall also
ensure that the remark “ sanctioned and paid Rs.
________________ on ____________ is duly
recorded in the ration card of the applicant so
that the applicant so that the applicant does
not get. scope for claiming financial assistance
more than once from various authorities within
the same financial year.
6.Referring a patient for
treatment outside the State
If
the Director of Health Services or the
Superintendent of IGM/GM/B.R.Ambedkar hospital
considers that proper facilities for treatment
of a particular case do not exist in Tripura and
it is necessary to refer the patient outside
Tripura for treatment, he shall indicate the
same in his report giving the name and place of
the hospital where the patient is referred for
treatment. In receipt of the report the Director
for Welfare of SC and OBC or the Secretary,
Department for Welfare of SC as the case may be
sanction financial assistance subject to limits
laid down under Rule – 4(iv)(b)(v) and (vi)
above.
7. Submission of progress report
The
sanctioning authorities other than the Director
for Welfare of SC & OBC and the Secretary/
Commissioner, Department of SC shall send
monthly progress reports of expenditure to the
Director for Welfare of SC & OBCs. The reports
of expenditure may be furnished in the proforma
to be supplied by the Director for Welfare of
SCs and OBCs.
8. MISC
i)
Matters not specifically covered by these rules
shall be governed by orders/instructions
issued by the Govt. from time to time.
ii) Any
doubt in respect of these rules may be referred
to the Government for clarification and the
clarification given by the Government shall be
final.
